28.06.10 - Federation of Small Business (FSB) Salisbury Trade Fair 2010

The Bloomsbury Residential team attended the annual FSB Salisbury Trade Fair at The Guildhall on Saturday 26th June 2010. They had a great day meeting people and chatting about our property services.

A big 'thank you' to all of our existing clients (landlords and sellers) who popped by to say 'hello'. It was also a great chance to let people know about the estate agency, lettings and property management services that we provide in the Salisbury area and surrounds.

11.06.10 - Crisis Square Mile Run 2010 - Update

Bloomsbury Residential director Rory James MacLaren-Jackson successfully completed the 6.5km Crisis Square Mile Run 2010 last Thursday in a time of 35mins 40 secs (and he's got the T-shirt and blisters to prove it!)

Thank you to everyone who sponsored Rory and helped him get well over the £100 target that Crisis were aiming for from each runner. By doing this Crisis can give Changing Lives Awards to 250 people, giving them the chance to study or train for a new job or giving them the skills and tools to become self employed. The money raised really does transform lives.

07.06.10 - HIPs and EPCs - An Update

Home Information Packs (HIPs) Abolished

As of late May 2010, Home Information Packs (HIPs) have been abolished. It is no longer a legal requirement to obtain a HIP before marketing a property for sale.

However, this change does not affect the need for Energy Performance Certificates (EPCs), which remain in force.

Energy Performance Certificates (EPCs) Still Required

An EPC is required for all homes when they are built, rented or sold.

If you are selling a property or letting a property you must have an EPC in place when doing so. EPCs are required on construction of new homes and are needed for rented homes the first time the property is let after 1 October 2008.

The certificate records how energy efficient a property is as a building. This efficiency is rated on an A-G scale, similar to the labels now provided with domestic appliances such as refrigerators and washing machines.

EPCs are produced using standard methods and assumptions about energy usage so that the energy efficiency of one building can easily be compared with another building of the same type. This allows potential buyers, tenants, owners, occupiers and purchasers to evaluate the energy efficiency and carbon emissions of the property so they can take into consideration energy efficiency and fuel costs as part of their prospective investment.

An EPC is accompanied by a recommendation report that lists cost-effective and other measures (such as low- and zero-carbon generating systems) that can improve the property’s energy rating. A rating is also given showing what could be achieved if all the recommendations were enacted.

The certificate is important because nearly 50% of the UK's energy consumption and carbon emissions are caused by the way buildings are lit, heated and used. Even minor changes in energy performance can have a significant effect in reducing energy consumption.

What an EPC looks like and contains

The certificate provides a rating for the building, showing its energy efficiency. The ratings are similar to those found on products such as fridges and are standard so the energy efficiency of one building can easily be compared with another building of a similar type.

For homes, two ratings are shown.

The energy-efficiency rating is a measure of a home's overall efficiency. The higher the rating, the more energy-efficient the home is, and the lower the fuel bills are likely to be.

The environmental impact rating is a measure of a home's impact on the environment in terms of carbon dioxide (CO2) emissions - the higher the rating, the less impact it has on the environment.

Each rating is based on the performance of the building itself and its services (such as heating and lighting), rather than the domestic appliances within it. This is known as an asset rating. The certificate also lists the potential rating of the building if all the cost-effective measures were installed.

The ratings will vary according to the age, location, size and condition of the building. The potential rating on the certificate will take these factors into account, and the suggested measures will be tailored so that they are realistic for the particular building.

Dealing with people and property all day long, it is easy to lose sight of the fact, amongst all the 'business' side of property, that for some people a roof over their head is a basic right denied to them. 20.05.10 - Home Information Packs (HIPs) Scrapped - The Practical Impact

In one of the first moves relating directly to the property market, the new coalition government has scrapped the controversial Home Information Pack (HIP) requirement from new sellers.

What is the practical impact for estate agents and property sellers?

Firstly, only homes marketed for sale on or after 21st May 2010 will no longer require a Home Information Pack (HIP). The suspension is not retrospective and so properties on the market on or before 20th May, either in breach of the HIP regulations or with ‘1st day marketing HIPs’ (i.e without searches, title or an Energy Performance Certificate) must still be completed.

YET virtually in contradiction - a Seller or Estate Agent is no longer under a duty to provide a copy of the HIP to potential buyers BUT commentary is that if there is an advantage in keeping the property move going forward then clearly they would be wise to.

Can Buyers still rely on a HIP after the suspension date? Yes. If the HIP was compliant with the regulations there is no reason why a buyer should not be able to trust it.

Energy Performance Certificates (EPCs) Remain Unaffected

Despite the suspension of HIPs, a Seller will need to have ordered, but not necessarily received an Energy Performance Certificate before legal marketing can start.

Once received it continues to be the rule that it must be provided to potential buyers at the earliest opportunity and before entering into a contract to sell the property. The Seller and Estate Agent must use all reasonable efforts to ensure that the EPC is available within 28 days of the property going on the market.

The duty to provide an EPC falls on either the seller, in the case of a building being sold, or the landlord / letting agent, in the case of a building being rented. In the case of new buildings the duty to provide an EPC falls on the builder.

Estate Agents will have to include energy information in written sales particulars, as was the case before the suspension of HIPs. They must do so as soon as the energy information becomes available. Enforcement of these requirements and financial penalties is the responsibility of Trading Standards Officers.

However, following the suspension of HIPs, all EPCs will now be valid for 10 years.
